Special Education: Laws, Policies and Disputes

In the United States, there is an entire area of the law that addresses special education and the needs of differently-abled children in public and private schools. In particular, Section 504 of the Rehabilitation Act mandates that states that schools cannot discriminate against an otherwise qualified student whose disability can be reasonably accommodated.

If that weren't enough, there is also a higher law that says "We are all God's children" — that each of us deserves to be treated with dignity, respect and compassion.

Fairness and Reasonable Accommodations

Contrary to popular belief, the word "fair," as someone once said, is not about everyone receiving the exact same thing; it's about everyone getting what they need. Unfortunately, in my practice as a lawyer for parents and schools, I have seen boards and administrators get mired in this concept in their efforts to maintain routine and discipline.

What needs to be understood is that the "reasonable accommodations" requirement is just that — reasonable. It doesn't necessarily mean you have to install an elevator to accommodate a child's needs if he or she can't get up and down the stairs himself or herself.
