Education Law Overview

A Big Picture View on Education Law

Mary Angela Shaughnessy, SCN — Louisville, Kentucky

Although in 1635, the Boston Latin School opened its doors and became the first publicly funded secondary school in the New World, religious sponsored schools were actually the first schools in America. Much has changed since. Consider that only 20 years ago the notion that student cell phones would become a ubiquitous problem in the classrooms of today would have been scoffed at, or that 30 years ago, computers in school were almost unheard of, or that little more than 50 years ago, separate schools for black students and white students were still an accepted part of our nation's culture.

Education law has changed as well and today is more complex, challenging and interrelated to other areas of the law than ever before.

What are your rights as the parent of a public or private school student? How does the U.S. Constitution intersect with administrative policy? What does "reasonable accommodation" really mean?
