Schools, Discrimination and the Law

The basic definition of discrimination in the United States is unequal treatment of any individual on the basis of a characteristic shared with others — be it race, religion, gender, age, disability or national origin. What this means for schools is that all persons deserve to be treated equal.

In my practice as a lawyer, I provide legal representation in Kentucky, as well as mediation, advocacy and consulting services nationwide to parents, principals and administrators with legal needs or disputes involving discrimination.

Honor Differences

We live in an increasingly multicultural and diverse world. Because of that, teachers, school officials, administrators and others in our educational systems are often faced with the question of whether to accommodate difference or stick to following the established rules. Based on my experience as an educator, and as both an attorney and a Sister, I say honor the differences.

In one instance, Catholic school officials sought my advice regarding a Muslim student who didn't want to wear the school's uniform because it contained an emblem of the cross. Although one solution to this dilemma was essentially just a minor tailoring alteration, prior to my involvement the school had refused to accommodate this request.

I advised them that they had two basic choices: One, hold their position and risk a discrimination lawsuit; or two, grant the request and make a reasonable exception. Wisely, they chose the latter.
